General conditions of sale
Article 1: Preamble
These general terms and conditions of sale apply to all contracts concluded between, on the one hand, Millimètres, whose registered office is located at Chaussée de Wavre 1257 in 1160 Brussels, registered with the Carrefour des Entreprises bank under number 032010, hereinafter referred to as "the seller" and, on the other hand, any consumer wishing to make a purchase via the "Millimètres" website, https://www.millimetres.be/ , hereinafter referred to as "the buyer".
A consumer is any natural person who acts for purposes which do not fall within the scope of his commercial, industrial, craft or liberal activity (art. I.1, 2° of the Code of Economic Law).
Article 2: Purpose
These conditions of sale aim to define the contractual relationship between the seller and the buyer as well as the conditions applicable to any purchase made through the Millimètres site.
The acquisition of a good through this site implies unreserved acceptance by the buyer of these general conditions of sale. These will prevail over any other specific conditions not expressly agreed to by the seller.
The seller reserves the right to modify its conditions of sale at any time. In this case, the applicable conditions will be those in force on the date of the order by the buyer.
Article 3: Characteristics of the goods offered
The products offered are those listed in the catalog published on the "Millimeters" website. Each product is accompanied by a description drawn up by the seller. The photographs in the catalog are provided for information purposes only and are not contractually binding, and cannot ensure an ideal similarity with the product offered, especially with regard to colors.
The indication of an available quantity reflects the stock status at the time of the last update of the seller's website. The stock status as it appears at the time the buyer consults the seller's website therefore has no contractual value.
Article 4: Price
The total amount of the buyer's order as displayed on the "Millimetres" website before final validation of the order is indicated in euros including all taxes (VAT and other applicable taxes and duties). The prices indicated do not include transport and delivery costs.
Shipping costs are established according to a price list with the total mass of the goods, including packaging elements, as the main reference.
The seller reserves the right to modify its prices at any time. However, the prices applicable to the order are those in effect at the time of confirmation of the order. The seller also reserves the right to reflect in its prices any changes in the VAT rate that occur before or on the delivery date.
Products purchased on promotion are neither returned nor exchanged.
Article 5: Orders
The buyer, who wishes to purchase a product or service, must:
- complete the identification form on which he will indicate all the requested contact details or give his customer number if he has one;
- complete the online order form, providing all the references of the products or services chosen;
- validate your order after having checked it;
- make the payment under the conditions provided;
- confirm your order and payment
- be over 18 years old
The sale is deemed complete upon confirmation of acceptance of the buyer's order by the seller. The confirmation is sent by email to the address provided by the buyer when ordering online. In all cases, the confirmation of acceptance of the buyer's order by the seller will contain the total price of the order and the details of the elements composing it (unit price excluding VAT, discounts, rebates, rebates, VAT tax base, VAT rate applied to each tax base, miscellaneous costs, etc.); a detailed description of the order placed by the buyer; the date of conclusion of the contract; the company name, full address of the registered office and the VAT number of the seller; the name and full address of the buyer's legal domicile; the approximate date or delivery time.
No shipment of goods will be made without confirmation of the order by the seller and payment of the total price of the order.
Article 6: Right of withdrawal
In accordance with the law, the consumer has the right to notify the seller that he is canceling his purchase, without penalty and without giving any reason, within fourteen (14) calendar days from the day after the day of delivery of the product (art. VI.47, § 1, of the economic law code).
Within this period, the consumer must notify his intention to withdraw using the withdrawal form template available online on the website www.millimetres.be
or by sending by email to the seller's contact address (contact@millimetres.be) an unambiguous statement setting out his decision to withdraw from the contract and returning, within fourteen (14) calendar days from the communication to the seller of his decision to withdraw, at his own expense and risk, the product delivered to the address: Chaussée de Wavre 1257 in 1160 Brussels.
Products must be returned in their original packaging, undamaged, accompanied by all their accessories and the original delivery note. Goods that are incomplete, damaged, damaged or soiled by the buyer will not be accepted.
After acceptance of the return of the goods and receipt thereof, the seller undertakes to reimburse any payment, with the exception of shipping costs, within 14 days after receipt of the goods. Unless otherwise agreed, the consumer may not exercise the right of withdrawal for the contract:
- supply of products made to consumer specifications or clearly personalized.
Article 7: Payment and payment terms
No shipment of goods will be made before payment of the total price of the order.
Any dispute relating to an invoice or any document in lieu thereof must be sent to us in writing, within three (3) clear days of its sending.
Article 8: Deliveries
Delivery, which is our responsibility, is made by the means of our choice, unless otherwise agreed in writing. Deliveries are made to the address indicated on the order form.
The goods are transported at the seller's risk until their delivery to the collection point indicated by the buyer when placing the order. From that moment on, the buyer alone assumes the risks.
In the event that the delivered goods are damaged, the buyer is obliged to refuse them or to accept them only by issuing a written reservation on the delivery note, to be completed together by the employee responsible for handing over the goods at the collection point. Any complaint relating to the delivered goods must reach the seller within five (5) clear days following the date of receipt. The complaint must be sent exclusively by registered letter to the address Chaussée de Wavre 1257 in 1160 Brussels) and be accompanied by a copy of the purchase document and the delivery note completed with the written reservation as mentioned above. After this period, no further complaints for apparent defects will be taken into consideration.
The delivery times communicated by the seller are strictly indicative. In all cases, the following circumstances release the seller from its obligations regarding deadlines:
1 - Cases of force majeure (including, in particular: strikes, technical incidents, supplier delays, stock shortages, labor shortages beyond the control of the seller);
2 - If the payment conditions are not respected;
3 - If changes are decided by the buyer after the order;
4 - If the buyer does not provide us with the desired information within the specified time.
Deliveries are usually made to the home by Bpost/ Fedex/ GLS. If desired, in agreement with the seller, the buyer can also take delivery of his order at the seller's head office or at one of its commercial establishments.
“Millimètres” reserves the right to refuse any order from a customer with whom there is a dispute (insolvency, bad payer, bad faith, etc.).
Article 9: Warranty
With regard to consumers, the seller guarantees the products it sells in accordance with the law of September 1, 2004 relating to the protection of consumers in the event of the sale of consumer goods (articles 1649 bis to 1649 octies of the Civil Code).
The consumer who notices the non-conformity of a product sold within two years of delivery of the goods must notify the seller within two months of the finding by registered letter addressed to the seller's head office (Chaussée de Wavre 1257 in 1160 Brussels). This guarantee only covers defects of conformity existing at the time of delivery of the goods. Defects or damage due to improper use, such as water damage, oxidation, falling or impact, negligence and wear, are not covered by the guarantee.
By purchasing an object of a craft nature, the buyer expressly acknowledges acquiring a creation of a nature distinct from that of an object of industrial manufacture with respect to which it is not reasonably and usually permissible to expect the same degree of resistance of materials or finish, in particular on the ergonomic and aesthetic levels. The colors and main aesthetic characteristics may differ from the illustrative photographs offered by the seller.
The provisions of Articles 1641 et seq. of the Civil Code relating to hidden defects are fully applicable. The products sold are guaranteed against hidden defects for a period of one year from their delivery or handover. The guarantee can only be implemented if the following conditions are met: (1) the defect renders the product, to a significant extent, unfit for the use for which it is usually intended or for a special use expressly mentioned in the special conditions of sale and (2) the product is or has been used under normal conditions. In order to be able to invoke the benefit of the guarantee, the buyer must notify his complaint relating to hidden defects by registered letter addressed to the seller's workshop (Chaussée de Wavre 1257 in 1160 Brussels) within a maximum period of one month after he has noticed or should normally have noticed the defects.
Article 10: Responsibilities
"Millimetres", in the online sales process, is only bound by an obligation of means. Its liability cannot be incurred for damage resulting from the use of the Internet network such as loss of data, intrusion, virus, service interruption, or other involuntary problems.
The data included on the site are also given in good faith. The links provided to the sites of manufacturers and/or partners are provided for information purposes only. The seller cannot be held responsible for information from these sites.
Article 11: Personal data
All personal data necessary for processing an order are kept by “Millimetres” and may be transmitted to companies with which the seller – or its suppliers – collaborate(s), when such communication is necessary for processing the order.
The user also authorizes "Millimètres" to use this data to establish statistics in order to improve its site, the goods and the service offered. This information may also be used to allow the dissemination, by any means of communication, of information relating to the commercial activities of "Millimètres" to its customers.
"Millimetres" finally retains personal data to facilitate subsequent orders and furthermore undertakes not to disclose the information it has to another company or business.
The data stored by “Millimetres” can be requested and corrected at any time upon simple request.
Article 12: Periodic information letter
By filling in the fields intended for the receipt of our periodic electronic newsletter, called "newsletter", the user expressly agrees to receive, at the email address provided and at regular intervals, information from the website manager. At any time, unsubscribing from the periodic newsletter is possible by clicking on the "unsubscribe" button (or bearing this mention in a similar wording) appearing at the bottom of each letter.
Article 13: Proof
The parties accept, within the framework of their relations, electronic means of proof (for example: electronic mail, automated computer recording of correspondence, etc.).
Article 14: Dispute Resolution
These online sales conditions are subject to Belgian law. In the event of a dispute, the courts of the seller's registered office shall have jurisdiction, unless there are binding public policy provisions.
